Influencer Contracts: What Every Brand Needs

A handshake deal with an influencer feels modern but creates real legal and operational risk. This guide covers the must-have clauses every influencer contract should include.

Deliverables and timeline

Specify exact content (1 Instagram Reel, 3 Stories, etc.), publication dates, and approval process. Vagueness kills campaigns.

FTC disclosure requirements

Mandate clear disclosure (#ad, #sponsored) at the top of every post. Failure to disclose creates FTC liability for both creator and brand.

Content rights

Specify usage rights — can you repost, run as paid ads, use on product pages? Default is one-time use; expanded rights cost more.

Exclusivity

If you don't want the creator promoting a direct competitor for 30-90 days, specify it. Without exclusivity language, you have none.

Payment terms

Net-30 is standard. Specify currency, payment method, and what triggers payment (publication date, not just contract signing).

Termination clauses

What happens if either party breaches? What if the creator deletes the post early? Spell it out.
